Pay Protection and Vacancy Bidding Reminder
Bidding for vacancy 21-06V closes Tuesday, January 26 at Noon CT. Pilots who wish to maintain pay protection provided by LOA 20-05 must be certain they have a bid in at 100 percent to the underlying category that is providing their pay protection (see below for more details).
Please be aware that even if there is no advertised vacancy for the category providing your pay protection, there could be secondary or backfill vacancies, so you need a bid in at 100 percent. In some cases, if there are backfills due to secondary vacancies and you did not have a bid in at 100 percent to your pay protection category you could lose pay protection.
This requirement for pilots who were displaced to bid the old seat that is providing pay protection is further explained below. Note that if you displaced to a higher paying pay band Category, see second example.
1. Displaced/Do Over to a Lower Pay Band Category:
To keep LOA 20-05 pay protection, a pilot that is displaced to a lower paying category needs to continue to comply with LOA 20-05 paragraph F.2 by having a bid or standing bid at 100 percent to the underlying category providing their pay protection. There can be bids to equal or higher pay band categories above that, but any lower pay band categories must be bid below that.
For example, a pilot displaced from EWR737CA to EWR737FO is pay protected to 737CA. In the G.3 do over process, if the pilot has selected EWR787FO, the pilot still needs to bid EWR737CA at 100 percent in order to maintain 737CA pay protection. In the case of a future displacement from EWR787FO, the pilot will keep 737CA pay protection in accordance with LOA 20-05 paragraph F.1.b, and the pilot will need to continue to comply with paragraph F.2 by bidding EWR737CA at 100 percent.
There can be other 737CA/320CA or higher pay band categories bid above EWR737CA, but any lower pay band categories must be bid below EWR737CA.
2. Displaced/Do Over to an Equal or Higher Pay Band Category:
If a pilot is displaced and is currently awarded an equal or higher paying category than what they were receiving on June 29, 2020, whether from the original displacement or the LOA 20-05 do over process, there is no need to have a bid to the old underlying category that would have provided pay protection. This is because the new position has a higher or equal pay rate than the old pay-protected position.
For example, a pilot displaced from EWR756CA to EWR737CA is pay protected to 756CA. In the G.3 do over process, if the pilot has selected EWR777CA, there is no need to bid EWR756CA or have a standing bid to EWR756CA unless the pilot does not want to keep the EWR777CA position. This does not jeopardize the pilot's 756CA pay protection. In the case of a future displacement from EWR777CA, the pilot will keep 756CA pay protection in accordance with F.1.b of LOA 20-05, and at that time the pilot will need to comply with F.2 by bidding EWR756CA to maintain the 756CA pay protection.
Additionally, pilots are reminded they do not need to bid the category they currently hold. Pilots should not have a vacancy bid for the same category as their starting position on the vacancy bidding page.

Q. Will there be grandfather rights in the upcoming vacancy bid? A. Yes. In accordance with the Pandemic Recovery LOA, pilots who were displaced in displacement bids 20-07D, 20-08D, and/or 20-09D will have grandfather rights for any vacancy bid that is opened on or before March 31, 2021. Pilots who were displaced in displacement bid 21-01D will have grandfather rights in accordance with the UPA, or for any vacancy bid that is opened on or before April 29, 2021. In a vacancy bid, pilots with grandfather rights receive a vacancy award, by seniority amongst other pilots with grandfather rights, before a vacancy award is made to pilots without grandfather rights.-updated 1/07/21
